I have more than 14 years experience exclusively in family law and I have a good understanding of how the system works in real life. What legal issues do you address in Family Law?
I help clients achieve the best possible outcomes in cases of divorce (including division of assets and debts, child custody, custodial schedules, child support, and spousal support) OR paternity (child custody, custodial schedules, and child support). I also can help you obtain a restraining order where necessary.
Are women favored in custody and support cases?
No, the court looks only to the best interest of the child in determining custody and custodial schedules. Support is determined without considering the gender of each parent, only their incomes and percentage of time responsible for the child are considered. If either the mother or the father has stayed home and gone without income during the marriage, that will be considered in both custody and support determinations the same way, whether that person was the mother or the father.
How much will my divorce cost?
There is absolutely no way for any attorney to accurately predict how a case will move forward. If both parties agree on every issue, you will be finished very quickly, maybe even after only 8-10 hours of attorney time. If there are disagreements over division of assets and debts, it will take longer. If there are disagreements over custody and support, those issues could be disputed over long periods of time, even years. I work hard to bring parties to a quick, reasonable, and economical resolution to their differences whenever possible.
How long will my divorce take?
In California, the earliest your divorce may be granted is 6 months and 1 day after you have filed your initial paperwork requesting a Dissolution AND had those papers served on the other party. No Judge has the authority to grant a divorce any earlier than that. If issues are not resolved and settlement isn't achieved during that six months, it will take longer. If you want to be divorced after the 6 months has passed, but before a settlement is reached or before a full trial (which takes place after temporary orders are in place and Discovery is completed), we can file a Motion requesting a Status Only Judgment (making you each single, but not resolving the division of assets, debts, support, or custody on a permanent basis).
